APD | India: Court to review scrapping of Article 370 in Jammu and Kashmir

New Delhi, Aug. 29 (APD) - The Supreme Court of India on Wednesday referred the issue of scrapping the special status of Jammu and Kashmir by the government to a panel consisting of five imminent judges.

The Supreme Court, which is the highest court in India will review the government’s decision to revoke the special status of Jammu and Kashmir that was given to the former province through Article 370 of the constitution.

According to judges, the orders of the Supreme Court will also be shared with the United Nations.

Article 370 was scrapped by a Presidential order on August 5, and the former state was bifurcated into two union territories, Jammu and Kashmir and Ladakh. Moreover, security limitations were imposed throughout Jammu and Kashmir that have still not been lifted.

Meanwhile, several petitions were filed challenging the constitutionality of revoking Article 370 in the court. While some were filed by individuals, others were filed by groups.

Mohammad Akbar Lone and Justice (retd) Hasnain Masoodi, who are both members of the Parliament had filed one of such petitions. As have former civil servants, defense personnel and professors, like Hindal Haidar Tyabji, Air Vice Marshal (Retd) Kapil Kak, Major General (retd) Ashok Kumar Mehta, former civil servant Amitabha Pande and professor Radha Kumar.
