HefacesachargeofescapingcustodyonhisreturntoNewZealand,whichcarriesamaximumpenaltyoffiveyearsimprisonment.

Hewassentencedtolifeimprisonmentin1996forstabbingtodeathamanwhosesonhehadbeensexuallyabusing.

Smith,whowasdeniedparolelastyearbecausehewasconsidered"highrisk"anda"seriousdanger"tothecommunity,abscondedfromthecareofafamilymemberduringa72-hourtemporaryreleasefromaprisonintheupperNorthIsland.
