AccordingtoBurhan,thestatusofasuspectshouldbemadeclearbeforeheorsheisdetained.Forexample,toarrestaterroristsuspect,thepoliceshouldproducestrongevidencethatthetargetisindeedinvolvedinterrorism.
Thereshouldbeevidencethatsomeonehasviolatedthelawbeforebeingdetained,Burhansaid.Otherwise,theauthoritytomakeanarrestcouldbeabusedbylawenforcers.
Similarly,theheadofKontras'civilandpoliticalrightsdivision,PutriKanesia,saidapresumptionofinnocenceclausewouldprotectsuspectswhohavenotyetbeenconvicted.ShecriticizedthecaseofSiyono,aterroristsuspectwhodiedwhileinthecustodyofDensus88.
Siyono'sdeadbodywascoveredinbloodandbruiseswhenitwasreturnedtohisfamilyfourdaysafterthearrest,raisingsuspicionthatthecounterterrorismsquadhadtorturedSiyonoduringitsinvestigation,accordingtoaKontrasinvestigation.
